LOVE BALIKBAYAN BOX

1. Definition of Shipment

A “Shipment” refers to all documents, parcels, and goods covered under a single receipt and transported via a sea carrier selected by LOVE BALIKBAYAN. Unless the Shipper requests a higher protection level and pays the corresponding fee, all shipments are transported under limited liability conditions.

2. Shipper’s Declaration and Liability

Shippers must provide a full and accurate declaration of all items in their shipment. LOVE BALIKBAYAN’s liability for loss, damage, or delay is as follows:

  • No Declared Value: Liability is restricted to reimbursement of the shipping charges, irrespective of the contents of the shipment.
  • Declared Value: Liability is capped at a maximum of AUD 300.00, irrespective of the shipment’s actual value.

3. Liability Limitations

LOVE BALIKBAYAN is not liable for loss, damage, or delay resulting from:

  • Natural disasters, storms, or acts of God
  • Acts of government, customs authorities, or quarantine agencies
  • Shipper negligence, improper documentation, or breach of these Terms & Conditions

4. Packaging Standards

Shippers must ensure that items are adequately and securely packaged. LOVE BALIKBAYAN is not responsible for damages caused by:

  • Leakage or spills
  • Improper or weak packaging
  • Fragile items broken due to inadequate protection

5. Non-Covered Damages

LOVE BALIKBAYAN shall not be liable for moral, exemplary, or consequential damages, unless such coverage is specifically included as part of an upgraded shipment service.

6. Shipper’s Warranties

The Shipper confirms that:

  • All shipment details, including names, addresses, and contents, are accurate.
  • No shipment shall contain prohibited or hazardous materials, including explosives, firearms, chemicals, or any illegal substances.

7. Delivery Acceptance

The Shipper guarantees that the Consignee, or an authorized person, will be present to receive the shipment on the scheduled delivery date. If no one is available, delivery may be made to another responsible individual at the same address.

8. Shipment Status and Claims

Shippers must track shipments via LOVE BALIKBAYAN’s Tracking Platform or other communications within seven (7) days of the first delivery attempt. Shipments unclaimed after thirty (30) days may be disposed of, with any proceeds applied to outstanding storage or handling fees.

9. Inspection Upon Receipt

The Consignee or authorized recipient must inspect the shipment immediately upon receipt. Failure to report damages or discrepancies at delivery is considered acceptance of the shipment in good condition.

10. Inspection Rights

LOVE BALIKBAYAN reserves the right to inspect shipments in the Shipper’s presence to verify contents. Shipments that do not comply with these Terms or legal requirements may be refused.

11. Claims Filing

All claims for loss, damage, or delay must be submitted in writing within thirty (30) days of the shipment transaction date. Claims submitted after this period will not be accepted.

12. Delivery Delays

Estimated delivery times are not guaranteed. Delays may occur due to shipping schedules, customs clearance, weather conditions, or port congestion.

13. Jurisdiction

All disputes arising from these Terms & Conditions are subject to the courts of Victoria, Australia.

14. Legal Capacity

Both parties confirm they are of legal age and have full legal authority to enter into this contract.

15. Terms Acknowledgment

By using LOVE BALIKBAYAN’s services, the Shipper acknowledges reading, understanding, and agreeing to these Terms & Conditions as displayed on the LOVE BALIKBAYAN website and declared in the shipment form.

 

Disclaimer of Warranties

LOVE BALIKBAYAN disclaims all warranties, express or implied, including those of merchantability, non-infringement, or fitness for a particular purpose. Services and content are provided ‘as is.

Limitation of Liability

LOVE BALIKBAYAN is not liable for any indirect, exemplary, penal, or consequential damages, including lost profits, data, or other losses, caused by the use or unavailability of its services or website.

Abandoned Goods Policy and Payment Terms

  • All goods or Balikbayan Boxes must be fully paid prior to or at the time of pickup.
  • The policy of ‘No Payment, No Load’ applies.
  • In the event of delayed payment, shipments may be rescheduled to the next available batch within one month.
  • Alternatively, goods may be collected by the customer at their own expense.
  • Any goods unclaimed two (2) weeks after this extension period will be considered abandoned, and ownership will transfer to LOVE BALIKBAYAN for disposal.

Storage Costs for Abandoned Goods

A monthly storage fee of 10% of the original shipping cost will apply for any abandoned goods that remain unclaimed.

Transfer of Ownership

If goods remain unclaimed two (2) weeks after notification, ownership will transfer to LOVE BALIKBAYAN, and the Shipper will lose all rights to the items or any proceeds from their disposal.

Direct Customer Transactions

LOVE BALIKBAYAN transacts exclusively with the paying customer. Third-party transactions are not accepted to preserve accountability and clarity.

Products and Services

Transportation products and services are governed by LOVE BALIKBAYAN’s local terms and conditions, which may differ based on the country of origin..
